General Terms and Conditions (GTC) of AATEILE GmbH

1. Scope of Application and Provider

1.2. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed. A business customer is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Conclusion of Contract 

2.1. The presentation of products in the online shop does not constitute a legally binding offer but a non-binding online catalog. 

2.2. By clicking the order button (e.g., "Order with obligation to pay"), you place a binding order for the goods in the shopping cart. 

2.3. The confirmation of the receipt of the order follows immediately after sending the order via email. The contract is concluded:

  • Credit Card / Stripe: Immediately upon completion of the payment process.

  • Bank Transfer (Prepayment / Invoice): Upon our acceptance of the order via a separate order confirmation or by dispatching the goods.

3. Prices and Payment Conditions 

3.1. The prices stated on the product pages include the statutory Value Added Tax (VAT) and other price components. 

3.2. Shipping costs are not included in the purchase price and will be clearly communicated during the checkout process. 

3.3. Payment Methods:

  • Credit/Debit Cards (Visa, Mastercard): Processed securely via Stripe. 3D Secure verification may be required.

  • Bank Transfer (SEPA): For advance payments.

  • Invoice (B2B Only): Only for approved business accounts. Payment terms: 30 days net, unless agreed otherwise. 

3.4. For business customers (B2B) outside Germany with a valid VAT ID, the invoice will be issued net (Reverse Charge), provided the goods legally leave Germany.

4. Shipping, Delivery, and Pickup 

4.1. Delivery is available to EU countries, the UK, and Norway. 

4.2. Delivery Times: Unless stated otherwise in the offer, the delivery time is 3-7 business days. 

4.3. Self-Pickup (Abholung): Customers may choose to pick up their orders at our warehouse: Allensteiner Str. 26, 77694 Kehl, Germany.

  • Pickup Hours: Mon-Fri 08:00 – 18:00 (CET).

  • Customers will be notified by email when the goods are ready for collection. 

4.4. Transport Damages:

  • For Consumers: If goods are delivered with obvious transport damage, please complain to the deliverer immediately and contact us. Failure to do so has no effect on your statutory warranty claims.

  • For Business Customers: The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the goods to the forwarder, the carrier, or the person or institution otherwise destined to carry out the shipment.

5. Core Parts (Exchange Items) 

5.1. Some items (e.g., alternators, calipers) may be subject to a core deposit (Pfand). This amount is added to the purchase price. 

5.2. The deposit will be refunded via the original payment method after the old part has been returned to us in the original manufacturer's box and inspected for remanufacturability (no cracks, no broken housing).

6. Retention of Title The goods remain our property until full payment has been made. For business customers, this applies to all claims from the ongoing business relationship.

7. Right of Withdrawal (Statutory for Consumers) Consumers have a statutory right of withdrawal of 14 days. (See separate "Cancellation Policy").

  • Exclusion of the right of withdrawal: The right does not apply to the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery (e.g., opened oil containers, fluids, chemicals).

8. Warranty and Liability 

8.1. The statutory liability for defects applies. 

8.2. Fitment Check: Before installation, the customer is obliged to check the accuracy of fit (visual comparison) of the delivered part with the original part. Parts that have been painted, modified, or forcibly installed despite being incorrect may be rejected for full refund or subject to compensation claims for loss of value.

9. Dispute Resolution The European Commission provides a platform for Online Dispute Resolution (OS): https://ec.europa.eu/consumers/odr/. We are not obligated and unwilling to participate in a dispute settlement procedure before a consumer arbitration board.
